Is an e-signature from DocuSend legally binding?
Yes, for the vast majority of business documents. In Canada, electronic signatures are recognised under PIPEDA Part 2 and each province's electronic commerce legislation, such as Ontario's Electronic Commerce Act, 2000. In the US they're covered by the ESIGN Act and UETA, and in the EU they're simple electronic signatures under eIDAS. A few documents, such as wills, some powers of attorney and certain land transfers, still need wet ink or special formalities in many provinces, so check if you're unsure.
Do the people I send documents to need an account?
No. Each signer gets a private link. They open it, agree to sign electronically, fill in their fields and adopt a signature. It takes about a minute on a phone or a computer.
What proves who signed and when?
Every completed envelope ends with a Certificate of Completion. It records each signer's name, email, IP address and device, when they viewed, accepted the disclosure and signed, plus a SHA-256 fingerprint of the original document.
Can someone change the PDF after it's signed?
Not without it showing. We store a SHA-256 fingerprint of every sealed PDF. Upload any DocuSend document at docusend.ca/verify and we'll tell you whether it matches the original record exactly.
Where is my data stored?
Documents and records are stored in Canada, in Montréal (AWS ca-central-1). They're encrypted in transit and at rest, and they're never public. Documents are only served through signed-in sessions or a signer's private link.
What file types can I send?
PDF, PNG and JPG. You can add several files to one envelope and DocuSend combines them into a single document, in the order you choose.
Your next agreement is one link away.
